Terms & Conditions

Dear holder,

We would like to welcome you to the Limassol AGORA Loyalty Card programme that was created for the Limassol AGORA associates and clients.

The holder of this card is entitled to special discount rates in the restaurants, cafes, bars and shops of Limassol AGORA.

In addition, the holder is also entitled to beneficial discounts for birthday Party Event and Kids Birthday Party.

Note: the above benefits are subject to the Terms & Conditions of the Limassol AGORA Loyalty Card.

In these Terms & Conditions (the “Terms”), the following expressions have the respective meanings ascribed to them below:
Applicant/s - means the persons who applied and/ or intend to apply and/or are eligible to apply for the issuance of a Loyalty Card.
Businesses - means the enterprises of Limassol AGORA and any other third parties participating in the Loyalty Scheme (as the case may be).
Cardholder - means the person to whom the Loyalty Card is issued subject to the present Terms as may be amended, and/or replaced from time to time.
Company - means TLM Operations LTD.
Loyalty Card shall mean and refer to collectively restaurants, café, bars, shops, and/or any other type of businesses located and/or operated in the Limassol AGORA and any other third parties participating in the Loyalty Scheme as expressly included (but not be limited to) in this Loyalty Card issued in accordance with the present Terms (as may be amended, and/or replaced from time to time).
Replacement Loyalty Card shall mean the Card issued to the Cardholder for the replacement of a lost, stolen or damaged Loyalty card.
Loyalty Scheme shall mean the loyalty program of TLM Operations LTD providing discounts and rewards to a Cardholder through the use of the Loyalty Card at the Businesses subject to the present Loyalty Card Term (as may be amended and/or replaced from time to time).

In accordance with the Cyprus Law for the Protection of Natural Persons with regard to the Processing of Personal Data and for the Free Movement of such Data of 2018 (Law 125(I)/2018) (the “GDPR”), the Personal Data shall mean any information relating to the applicants and/or Cardholders provided by them to the Company which identifies or may identify them when collected for the purposes of providing the best possible service to the Cardholders. The Company collects personal data from the Cardholders in order to process requests in relation to the provision of the benefits offered under the Loyalty Card to its holders. All such data remains confidential and is not disclosed to any third parties except as prescribed by the GDPR. The Cardholder has the right to access, amend or delete such data and to refuse any processing thereof all in accordance with the GDPR respectively.

Terms shall mean the following Terms & Conditions and any amendments, and/or replacements thereof. The following Terms are read and enforced together with the Limassol AGORA Privacy Policy located at TLM OPERATIONS LTD head office which is located at Kanari 47-49, Limassol 3041, Cyprus. Tel.: 700 700 70.

The Terms regulate the operation of the Loyalty Scheme carried out through the Loyalty Card. The Terms apply to the use of your Loyalty Card and govern the relationship between the Company, and the Loyalty Cardholders respectively.

The aim of the Loyalty Scheme is to reward Limassol AGORA customers with special discounts and/or offers in the Businesses as set out in the Terms.

ELIGIBILITY AND REGISTRATION PROCEDURE
To be eligible for a Limassol AGORA Loyalty Card you must be over 18 years of age.
The Loyalty Card shall be issued to natural persons only, free of charge and with no obligation to buy anything.
The registration to the Loyalty Scheme is done through a hard copy form, included in your welcome pack and will also be available upon request. The hard copy form needs to be returned to the Limassol AGORA head offices at Constantinou Kanari 47 - 49, 3041, Limassol Cyprus once fully completed and signed.
The necessary requirements for a successful registration are the following:
· All required fields of the application form need to be completed.
· The applicants must accept the Terms and Conditions.
· The applicants must consent to the collection, processing and use of their Personal Data.
The Company reserves the right to refuse entry to the Loyalty Scheme without providing any justification. In the event the applicant submits false information to the Company, the applicant is liable to the Company for any damages suffered.

CANCELLATION
Each Cardholder may request cancellation of the Loyalty Card by contacting TLM OPERATIONS LTD head office which is located at Kanari 47-49, Limassol 3041, Cyprus. Tel.: 700 700 70.
The Company shall not be liable and the Cardholder shall have no rights against the Company for any direct or indirect, existing or future losses connected to the cancellation or revocation of the Loylaty Scheme and the Loyalty Card.

DISCOUNT
Different discounts and Businesses are applicable to the Limassol AGORA Loyalty Card. The Loyalty Card must be shown before each payment, to make use of the discount. The discount will be shown on the receipt. No discount shall be granted during sale periods, on special offers, pre payments, guarantee payments and gift cards. In case of events happening in Agora or vendor location the loyalty card cannot be applied. The Company shall have the right to change the discount levels at its absolute discretion without the prior consent of the Cardholder. Such amendments shall be published on Limassol AGORA website at www.limassolagora.com


PARTICIPATING BUSINESS
DLimassol AGORA reserves the right to integrate a new Business or to remove an existing Business from the Loyalty Scheme at its absolute discretion without the consent of the Cardholder. The list of participating Businesses and any amendments thereof shall be published on Limassol AGORA website at limassolagora.com.
Limassol AGORA shall not be liable in the event any of the Businesses participating in the Loyalty Scheme discontinue their participation, and/or withdraw any of the products/services offered.

LOSS AND REPLACEMENT OF THE LOYALTY CARD
If you believe that your Loyalty Card has been lost or stolen and there has been unauthorised use, your responsibility to inform Limassol AGORA accordingly. Limassol AGORA shall not be liable for misuse of a lost or stolen Loyalty Card or for any unauthorised use of a Loyalty Card.
A replacement Loyalty Card can be issued on request when the Loyalty Card has been lost, stolen or damaged. The Company is entitled to charge a fee for the issuance of such replacement when the

The Company may refuse to issue a replacement Loyalty Card at it is sole discretion or in cases where reasonably believes that the Loyalty Card has been lost, stolen or damaged due to your wilful breach of the Terms or if there are reasonable grounds for suspecting that you have been engaged in a fraudulent or other unlawful conduct.

OWNERSHIP AND USE OF THE LOYALTY CARD
The Loyalty Card is not redeemable for cash and cannot be used for payments of goods or services.
The Loyalty Card will remain the property of the Company. The Loyalty Card is strictly personal, non-transferable and equipped with a unique number. The Cardholders are not allowed to lend out them Loyalty Cards.

GENERAL DATA PROTECTION REGULATION
The CompaCompany always collect and process personal data according to the provisions of the General Data Protection Regulation (EU GDPR) 2016/679 and the Protection of natural persons with regard to the processing of personal data and on the free movement of such data Law 125(1)/2018 (the “Data Protection Law”), as amended from time to time. The applicants acknowledge that by completing the application form, their personal data will be collected, processed and used by the Company lawfully and fairly for the purpose of the issuance of the Loyalty Card and consent to this. The applicant or the Cardholder has the right to withdraw their consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

APPLICABLE LAW
The Terms and conditions are governed by the laws of the Republic of Cyprus, the courts of which shall have exclusive jurisdiction over any disputes arising hereunder and/or from the use of the Loyalty Card and/or from participation in the Loyalty Scheme.

OTHER TERMS
The company may amend, withdraw, suspend and/or interrupt the Loyalty Scheme or any part thereof at any time, in its sole discretion. These Terms and Conditions may be amended from time to time without notice and any changes will take effect immediately upon publication on Limassol AGORA website at limassolagora.com and/or by any other reasonable means at the Company's reasonable discretion. By using the Loyalty Card, you are indicating your agreement to be bound by these Terms and Conditions as may be amended, and/or replaced from time to time. The Company shall not be responsible or liable in case of failure on the part of the Cardholder to be informed about the changes that have occurred and have been publicly disclosed as described above.
